II. Terms and Conditions of Sale

 
1.DEFINITIONS

 
1.1The term ‘you’ refers to the user, viewer and purchaser of our website.

1.2"Goods" means one or more products available for purchase on the Website which the visitor purchases as detailed in the Basket.

1.3"Basket" means the screen displayed on the Website which details the Goods and/or Services, the Price and other relevant details including, without limitation, delivery details.

1.4"Order" means an order for Goods and/or Services paid for by the Purchaser via the Website but not yet delivered and/or performed, as applicable.

1.5"Price" means the purchase price displayed in the Basket, payable by the Purchaser for the Goods and/or Services and Delivery Price.

1.6"Delivery Price" means the applicable rate for delivery displayed in the Basket.

1.7"Effective Date" means the date on which the Purchaser clicks "I Accept" to accept the terms and conditions of this Agreement.

2. Your Status


By placing an order with us, you warrant that:

2.1 You have the right, authority and capacity to enter into binding contracts;

2.2 You are a least 18 years old.


3. Our Contract


3.1 When you decide to place an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card use to place your order.

 
3.2 After placing an order, you will receive an e-mail from us confirming receipt of your order. This e-mail does not mean that your order has been accepted. Our contract between you and us is subject to acceptance by us and such acceptance will be confirms to you by an e-mail that will confirms that your ordered goods have been dispatched to you.

 
Our Contract will relate only to those Products whose dispatch have been confirmed in the Dispatch Confirmation.


3.3 If for any reason hecosmetics is not able to receive or to stock again the relevant Good(s) or provide the relevant Services, hecosmetics will be entitled to cancel an accepted Order or any part thereof by notice to the Purchaser. In such circumstances, hecosmetics will refund to the Purchaser such portion of the Price as relates to the Good(s) and/or Services that hecosmetics is unable to provide.

 
4. Prices


4.1All prices are inclusive of VAT. Delivery cost will be charged for every order under £20 in the UK and under £50 for the rest of the world. See our Delivery policy.


Please note that the price does not include any import duties or taxes which may be levied by any local authorities if the goods are to be delivered outside the United Kingdom. Any additional duties or taxes must be paid directly to the relevant body or by you. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.


4.2 The price of any Products is clearly quoted on our website.


4.3 We reserve the right to change our prices but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.

 
5. Payment


The payment for you order will be required at the stage of you processing payment on the website.

 
6. hecosmetics despatch policy and Commitment

 
6.1 All orders placed before 10am will be despatched the same day on working days (Monday to Friday). Orders placed on weekend and bank holidays will be despatched the next working day.


Please ensure that there is someone available at the delivery address to receive your order.


7. Guarantee and Returns


7.1 If you are contracting as a consumer, The Distance Selling Regulations give you the right to cancel an order within seven working days.


7.2 You will be liable for the costs of returning any Goods following the cancellation of a contract under the Regulations.


7.3 To cancel a Contract, you must inform us in writing by letter with postage certificate or recorded delivery within seven days after reception of goods. (Please note that we cannot accept liability for items lost in the post so we recommend you to retain your recorded delivery receipt as proof of postage).


7.4 You must also return the Product(s) to us immediately, in the same condition in which you received them (assuming they are in their original, unopened and unused condition).

 
In this case, you will receive a full refund of the price paid for the Product(s) within 30 days of the day you have given notice of cancellation.

 
Please note that you have a legal obligation to take reasonable care of the Products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.

 
7.5 In case of defective product you must inform us by letter within seven days after reception of the good(s) and you must also return the product to us immediately. Then we will notify you by e-mail if you are entitled to a refund for a defective product. If a refund is accepted we will refund you the total cost of postage out and in.


8. Hecosmetics Warranties & Liabilities


8.1 We warrant to you that any Product purchased from us through our site is of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied.

 
8.2 All information provided on the Website by hecosmetics is intended as information and opinion only and as such does not constitute advice.


8.3 hecosmetics will not be responsible or liable for delays or any failure resulting from circumstances beyond its reasonable control including courier and/or postal services and other force majeure events (strike, fire, explosion, storm, flood, failure of public or private transport, decrees, legislation, regulations or restrictions of any government).
